1. QUI COLLECTE VOS DONNÉES À CARACTÈRE PERSONNEL

Les sociétés qui collectent et traitent les données à caractère personnel en tant que responsables autonomes du traitement des données (ci-après désignées les « Responsables du traitement » ou les « Sociétés ») ou en tant que responsables conjoints du traitement sont :

OTB (Maison mère de Diesel S.p.A. et de Diesel Inc.) et le Siège de Diesel exercent des activités en tant que responsables conjoints du traitement, en prenant conjointement les décisions en ce qui concerne les finalités et les moyens du traitement des données à caractère personnel. Ci-après, le terme « Responsables conjoints du traitement » signifie le Siège de Diesel et OTB considérées conjointement quand elles traitent les données en tant que responsables conjoints du traitement.



Pour faciliter votre compréhension des activités de traitement réalisées par les sujets susmentionnés en tant que Responsables ou Responsables conjoints du traitement, nous avons préparé ce document qui explique quelles sont les activités de traitement qui sont effectuées de façon autonome par chaque société.

2. QUELLES SONT LES DONNÉES À CARACTÈRE PERSONNEL QUE NOUS TRAITONS

Chaque Société collecte différentes catégories de données à caractère personnel en fonction de la finalité pour laquelle elle les traite.

Nous précisons ci-dessous quelles sont les catégories de données à caractère personnel qui sont collectées ; dans le paragraphe suivant, nous expliquerons pour quelles finalités chaque catégorie de données est traitée par chacun des Responsables du traitement ou par les Responsables conjoints du traitement selon les cas (ci-après également désignées « Données à caractère personnel » si traitées conjointement).

Données biographiques : prénom, deuxième prénom, nom, date de naissance, sexe ;

Coordonnées : adresse de résidence (rue, ville, province, pays, code postal), domicile, adresse courriel, numéro de téléphone, numéro de mobile ;

Données de vente : adresse de livraison et de facturation, mode de livraison et paiement, nom du titulaire de la carte de crédit et date d’expiration de la carte, informations requises par le Service Client, numéro de TVA et/ou numéro d’identification fiscale, numéro de passeport, numéro de carte Global Blue ;

Données de suivi des bulletins d’information et Données d’actions : informations en ce qui concerne l’ouverture des bulletins d’information ou des liens ;

Données collectées en boutique : anniversaire, tranche d'âge présumée, dans certains pays, les identifiants des réseaux sociaux, sexe, méthode et date d’inscription, préférences en ce qui concerne le vendeur et l’assistant à la vente, langue, catégories de produits d'intérêt, modes d'utilisation des services, préférences sur les services éventuellement observées en boutique, campagne de remboursement, participation à des événements, autres marques achetées, produits essayés dans la cabine d’essayage mais non achetés ;

Données d’achat : détail des produits achetés en ligne ou en boutique (par exemple taille, prix, réduction, modèle, collection, calcul du niveau de dépenses, panier abandonné, etc.) ;

Données de fidélité : vos données collectées en tant que membre du programme de fidélité « House of Diesel », dont le règlement est disponible au lien suivant, et fondé sur votre engagement envers la marque (par exemple, « j'aime », « commenter », « partager », « sauvegarder », « suivre le compte officiel Diesel », « partager des photos sur la plateforme communautaire », « créer la liste d’envies et l’avatar pour la boutique en ligne », etc. sur les médias sociaux) ;

  • Données de navigation : données relatives au comportement de navigation et/ou utilisation des sites web des Responsables du traitement, par exemple à l’aide des cookies ou des informations en rapport avec les pages qui ont été visitées ou cherchées ou en lien avec la liste de souhaits, collectées lors de la navigation ou lors des achats sur la boutique en ligne. 3. POUR QUELLES FINALITÉS TRAITONS-NOUS VOS DONNÉES À CARACTÈRE PERSONNEL

Dans ce paragraphe, nous expliquons quelles sont les finalités pour lesquelles chaque catégorie de données est traitée par chaque Responsable du traitement ou Responsable conjoint du traitement.

3.1 FINALITÉS DE DIESEL USA Inc. (DIESEL)

Diesel est la société qui gère le commerce en ligne par l’intermédiaire du Site et à laquelle vous avez demandé des services d’assistance. Dans certains cas, il peut être nécessaire que Diesel connaisse certaines informations vous concernant, afin de traiter des demandes spécifiques que vous pourriez soumettre. Diesel traitera les Données à caractère personnel pour les finalités suivantes.

a. Activités de vente et réponse à d’autres demandes faites par les clients

Si vous achetez des produits Diesel par l'intermédiaire du service de commerce en ligne sur le Site ou par l'intermédiaire d’autres méthodes offertes directement par Diesel, Diesel traitera vos Données biographiques, vos Coordonnées, vos Données de vente et vos Données d’achat pour conclure la vente, ainsi que pour toutes les activités étroitement liées et en rapport avec celle-ci, telles que la livraison, où le service est disponible pour la collecte en boutique et le retour en boutique, ou toute autre obligation administrative ou comptable.

De même, il se pourrait que Diesel doive vérifier les conditions requises pour participer à des programmes spéciaux de réduction (par exemple en vérifiant si l’achat effectué est un premier achat ou autres conditions requises par le règlement) et traiter vos Données biographiques ou vos Coordonnées pour répondre à toute demande supplémentaire que vous pourriez formuler par l'intermédiaire du Site ou du Service client, par téléphone ou chat, telle que des demandes d’informations, d’assistance, ou d’être informé(e) par courriel quand un produit désiré ou une taille sont à nouveau disponibles sur le Site, par l’intermédiaire de la fonction « M’avertir ».

Fondement juridique : ce traitement se fonde sur l’exécution d’un contrat d’achat auquel vous êtes partie ; la fourniture des Données à caractère personnel énumérées ci-dessus est nécessaire à cette fin ; en cas de non-fourniture des données, Diesel ne pourra pas traiter votre demande.

b. Inscription au programme de fidélité

Les Données biographiques, les Coordonnées, les Données d’achat et les Données de fidélité seront également collectées par Diesel pour gérer votre demande de participation au programme de fidélité (appelé « House of Diesel », dont le règlement est disponible au lien suivant). Ces données seront traitées à la fois pour compléter votre adhésion et pour toutes les finalités étroitement liées à celle-ci ou instrumentales, y compris - en premier lieu - toutes les activités offertes par le programme de fidélité. L’inscription peut avoir lieu : i) en ligne par l’intermédiaire du Site ; ii) hors ligne dans les boutiques participantes, en remplissant le formulaire d’inscription disponible en format électronique (tablette ou autre dispositif intelligent) ou par l’intermédiaire de dépliants (distribués dans les boutiques) avec un code QR spécial par le biais duquel les clients peuvent adhérer au programme via le Site, iii) par l’intermédiaire d’autres canaux officiels de Diesel S.p.A., (par exemple, mais sans s’y limiter, les réseaux sociaux tels que Facebook, Instagram, WeChat, etc.), ou iv) par l’intermédiaire du Service Client.

Toutes les communications en lien avec le programme de fidélité seront faites par Diesel par l’intermédiaire du Site, par SMS, MMS, portefeuille électronique, courriel, bulletin d’information, réseaux sociaux et/ou tout autre canal de communication officiel de Diesel. Toutes ces communications liées au programme en lui-même sont envoyées uniquement dans le but d’offrir les avantages qui y sont liés et ne constituent pas des communications de marketing.

De plus, en créant un compte sur le site web dans l’espace réservé, l’Utilisateur fera partie du programme de fidélité de Diesel. Si vous souhaitez profiter des services disponibles sur le Site (par exemple, acheter des produits) sans adhérer au programme, il vous suffit de choisir l'option « Invité » lorsqu'elle est disponible (par exemple, lors du règlement des paiements).

Fondement juridique : ce traitement se fonde sur l’exécution d’un contrat d’adhésion au programme de fidélité auquel vous êtes partie ; la fourniture des Données à caractère personnel énumérées ci-dessus est nécessaire à cette fin ; en cas de non-fourniture des données, Diesel ne pourra pas traiter votre demande.

c. Participation à des concours

Diesel pourra traiter vos Données biographiques pour vous permettre de participer à des concours organisés par Diesel. Dans certains cas, par exemple pour traiter la livraison du prix, il se peut que le traitement concerne également vos Coordonnées. Si, pour participer à un concours, des informations supplémentaires sont nécessaires, celles-ci vous seront demandées à l’occasion de la publication d’une politique spécifique relative à la protection de la vie privée.

Fondement juridique : ce traitement se fonde sur l’exécution d’un contrat de participation au concours en question auquel vous êtes partie ; la fourniture des Données à caractère personnel énumérées ci-dessus est nécessaire à cette fin ; en cas de non-fourniture des données, Diesel ne pourra pas traiter votre demande.

d. Marketing

Seulement après avoir obtenu votre consentement, Diesel traitera les Données biographiques, les Coordonnées et les Données collectées en boutique à des fins de marketing, y compris à des fins d’audience personnalisée, c’est-à-dire pour faire de la publicité sur les réseaux sociaux auxquels vous êtes inscrit(e) ou pour envoyer du matériel publicitaire ou de vente directe, pour réaliser des études de marché et pour faire de la communication commerciale à l'aide de moyens de communication automatisés (courriel, bulletin d’information, SMS, MMS, plateformes de messagerie en ligne, etc.).

Fondement juridique : ce traitement se fonde sur le consentement que vous avez donné par l'intermédiaire du régime « opt-in » approprié.

Dans le cas où vous seriez inscrit(e) au programme de fidélité et que vous décidiez de retirer votre consentement à des fins de marketing, vous continuerez à recevoir des communications en rapport avec les avantages (comme le cadeau de date de naissance ou d’anniversaire ou l’accès anticipé aux nouvelles collections et les promotions exclusivement réservées aux membres). Si, en plus du retrait de votre consentement, vous ne souhaitez plus recevoir ce genre de communications, il vous sera demandé de le préciser. Tout retrait du programme de fidélité entraînera également la suppression de votre compte en ligne, si vous en possédez un.

Vous pouvez à tout moment retirer votre consentement en ce qui concerne la réception des communications susmentionnées en cliquant sur l’option prévue à cet effet indiquée dans chaque courriel marketing reçu, ainsi qu’en écrivant à l’adresse privacy@diesel.com, ou encore en contactant la société aux adresses indiquées dans le paragraphe 1.

3.2 FINALITÉS DE DIESEL CANADA

Diesel Canada est la société qui gère la boutique où vous avez acheté un produit et à laquelle vous avez demandé des services d’assistance. Diesel Canada traitera les données à caractère personnel pour les finalités suivantes.

a. Activités de vente et réponse à d’autres demandes faites par les clients

Si vous achetez des produits Diesel en visitant nos boutiques, Diesel Canada traitera vos Données biographiques, vos Coordonnées, certaines Données de vente et vos Données d’achat pour conclure la vente, par téléphone ou par l’intermédiaire d’autres méthodes offertes par Diesel Canada, ainsi que pour toutes les activités étroitement liées et en rapport avec celle-ci, telles que la livraison ou toute autre obligation administrative ou comptable. De plus, ces données seront également traitées pour vous recontacter pour des raisons liées à votre achat, par exemple en cas de réclamation, pour rappeler un produit défectueux et/ou dangereux ou, en général, pour des raisons techniques, par exemple, liées à la gestion des problèmes de paiement par carte de crédit refusé et similaires.

De même, il se pourrait que Diesel Canada doive vérifier les conditions requises pour participer à des programmes spéciaux de réduction (par exemple en vérifiant si l’achat effectué est un premier achat ou autres conditions requises par le règlement) et traiter vos Données biographiques ou vos Coordonnées pour répondre à toute demande supplémentaire que vous pourriez formuler par l'intermédiaire du Site ou du Service client, par téléphone ou chat, telle que des informations ou des demandes d'assistance.

Fondement juridique : ce traitement se fonde sur l’exécution d’un contrat d’achat auquel vous êtes partie ; la fourniture des Données à caractère personnel énumérées ci-dessus est nécessaire à cette fin ; en cas de non-fourniture des données, Diesel ne pourra pas traiter votre demande.

b. Services après-vente

Diesel Canada peut collecter vos Données biographiques et vos Coordonnées pour traiter des demandes spécifiques que vous pourriez formuler en boutique, après la vente ; par exemple, pour effectuer une réparation ou une personnalisation, pour demander une livraison à domicile ou pour organiser un retour.

Fondement juridique : ce traitement se fonde sur l’exécution d’un contrat auquel vous êtes partie ; la fourniture des Données à caractère personnel énumérées ci-dessus est nécessaire à cette fin ; en cas de non-fourniture des données, Diesel ne pourra pas traiter votre demande.

c. Gestion des contacts – recontacter le client

La Filiale Diesel peut avoir besoin d’utiliser vos Données biographiques et vos Coordonnées afin de vous recontacter au cours du processus après-vente si nécessaire (par exemple mais sans s’y limiter, il peut être nécessaire de vous recontacter en cas d’articles oubliés en boutique, pour rendre les articles perdus, etc.).

Fondement juridique : ce traitement se fonde sur l’intérêt légitime de la Filiale Diesel de continuer à améliorer ses performances et ses relations avec les clients.

3.3 FINALITÉS DE DIESEL S.P.A. (SIÈGE DE DIESEL)

Le Siège de Diesel est la société qui conçoit, vend et organise la promotion des produits de la marque « Diesel ». C’est la société qui maintient les contacts avec vous si vous décidez de participer à des initiatives promues par Diesel comme des concours ou autres initiatives promotionnelles ; le Siège de Diesel est également la société qui gère le programme de fidélité auquel vous pouvez adhérer. Le Siège de Diesel traitera les Données à caractère personnel pour les finalités suivantes.

a. Inscription au programme de fidélité

Les Données biographiques, les Coordonnées, les Données d’achat et les Données de fidélité seront également collectées par Diesel pour gérer votre demande de participation au programme de fidélité (appelé « House of Diesel », dont le règlement est disponible au lien suivant). Ces données seront traitées pour compléter votre adhésion et pour toutes les finalités étroitement liées à celle-ci ou instrumentales, y compris - en premier lieu - toutes les activités offertes par le programme de fidélité. c. Marketing

Seulement après avoir obtenu votre consentement, le Siège de Diesel traitera les Données biographiques, les Coordonnées et les Données d’achat à des fins de marketing, y compris à des fins d’audience personnalisée, c’est-à-dire pour faire de la publicité sur les réseaux sociaux auxquels vous êtes inscrit(e) ou pour envoyer du matériel publicitaire ou de vente directe, pour réaliser des études de marché, pour faire de la communication commerciale à l'aide de moyens de communication automatisés (courriel, bulletin d’information, SMS, MMS, plateformes de messagerie en ligne, etc.) et de moyens de communication traditionnels (courrier).

Fondement juridique : ce traitement se fonde sur le consentement que vous avez donné. Dans le cas où vous seriez inscrit(e) au programme de fidélité et que vous décidiez de retirer votre consentement à des fins de marketing, vous continuerez à recevoir des communications en rapport avec les avantages (comme le cadeau de date de naissance ou d’anniversaire ou l’accès anticipé aux nouvelles collections et les promotions exclusivement réservées aux membres). d. Satisfaction Client

Diesel peut utiliser vos Coordonnées pour mener des enquêtes visant à mesurer le niveau de satisfaction (c'est-à-dire la satisfaction du client) à l'égard du service fourni (à titre d'exemple, mais sans s'y limiter : enquêtes après-vente en boutique ; enquêtes après-vente en ligne ; enquêtes sur les achats d'occasion, etc.) Veuillez noter que, dans tous les cas, les communications effectuées à cette fin n'auront pas de contenu publicitaire, ni ne seront destinées à la vente directe, et ne seront pas utilisées pour des études de marché ou des communications commerciales.

Fondement juridique : ce traitement se fonde sur l’intérêt légitime de Diesel de vérifier et d’améliorer la qualité de ses services.

e. Autres activités administratives ou comptables

Diesel peut également traiter vos Données à caractère personnel à des fins administratives, comptables et d'analyse statistique interne pour la planification des activités.



Fondement juridique : ce traitement se fonde sur l’intérêt légitime de Diesel d’améliorer la qualité de ses services et de ses activités.

3.4 FINALITÉS DES RESPONSABLES CONJOINTS DU TRAITEMENT (SIÈGE DE DIESEL ET OTB)

Le Siège de Diesel et OTB opèrent en tant que responsables conjoints du traitement sur la base d’un accord spécifique pour la finalité indiquée ci-dessous.

a. Profilage client

Avec votre consentement, les Responsables conjoints du traitement auront le droit de traiter les Données biographiques, les Coordonnées, les Données de vente, les Données collectées en boutique, les Données d’achat, les Données de fidélité, les Données de suivi des bulletins d’information, les Données d’actions et les Données de navigation à des fins de profilage et pour l’analyse commerciale, c’est-à-dire pour l'analyse de vos préférences d’achat consistant en un traitement automatisé des données à caractère personnel susmentionnées. Ce traitement vise à connaître ou à prévoir de façon analytique vos préférences d’achat également pour créer des profils clients et pour personnaliser l’offre commerciale afin qu’elle corresponde davantage à vos préférences.

Fondement juridique : ce traitement se fonde sur le consentement que vous avez donné.

Vous aurez le droit à tout moment de retirer votre consentement soumis à profilage en écrivant à privacy@diesel.com ou en contactant les Responsables conjoints du traitement aux adresses indiquées dans le paragraphe 1.

3.5 FINALITÉS DE TOUS LES RESPONSABLES DU TRAITEMENT (DIESEL, SIÈGE DE DIESEL, OTB) OU DES RESPONSABLES CONJOINTS DU TRAITEMENT (SIÈGE DE DIESEL ET OTB)

Enfin, chaque Responsable du traitement ou Responsable conjoint du traitement peut avoir besoin de se conformer à une disposition légale spécifique à laquelle il est soumis ou de défendre ses droits en justice.

a. Finalités en lien avec les obligations établies par les lois ou les règlements, par les décisions/demandes des autorités compétentes ou par les organes de contrôle et de surveillance

Chaque Responsable du traitement ou Responsable conjoint du traitement peut traiter vos Données à caractère personnel pour se conformer à l’obligation légale à laquelle il est soumis.

Fondement juridique : respect d’une obligation légale.

6. COMMENT ET PENDANT COMBIEN DE TEMPS TRAITERONS-NOUS VOS DONNÉES À CARACTÈRE PERSONNEL

Les Données à caractère personnel fournies et/ou collectées par les Responsables du traitement ou les Responsables conjoints du traitement sont traitées et conservées à l’aide d’outils automatisés et, dans certains cas, peuvent être traitées et conservées sur un support papier. Les Données à caractère personnel traitées à des fins de marketing et de profilage client seront notamment saisies et conservées dans les systèmes GRC qui permettent de traiter les Données à caractère personnel à ces fins.

Les Données à caractère personnel seront conservées pour la durée nécessaire à l’exécution des finalités pour lesquelles elles ont été collectées. En particulier, les règles suivantes s’appliqueront :

les données collectées pour conclure et exécuter des contrats d’achat sur le Site ou en boutique, y compris les paiements : jusqu’à la conclusion des obligations administratives et comptables. Les données de facturation seront conservées pendant 10 ans à partir de la date de facturation ;

    • Internet, technical or other similar network activity/navigation data, which may include usage and browsing history; device information, including device properties; network connection information, such as time zone; search history; information on your interaction with our Site, newsletters, or links; and error logs.     3. FOR WHAT PURPOSES WE PROCESS YOUR PERSONAL DATA


    In this paragraph we further explain for what purposes each category of data is processed by each Data Controller or Joint Controller.

    3.1 PURPOSES OF DIESEL USA Inc. (DIESEL)


    Diesel is the company that manages the e-commerce via the Site and the shop where you purchased a product and to which you have requested assistance services. In some cases, it may be necessary for Diesel to become aware of some information concerning you, to process specific requests you may have. Diesel will process Personal Data for the following purposes.

    a. Sales activities and response to other requests made by customers

    If you purchase Diesel products through the e-commerce service on the Site or in shops, Diesel will process your identifiers, contact data, biographical data, sales data and purchase data to conclude the sale, as well as for all activities strictly connected and related to it, such as delivery or other administrative and accounting obligations.

    Similarly, Diesel may need to verify the requirements for participating to special discount programs (e.g. verifying if the purchase made is a first purchase or other requirements of the regulation) and to process your identifiers, contact data, and biographical data to respond to any further requests that you may formulate through the Site or through the Customer Service, through telephone or chat, such as requests for information, assistance, or to be notified by email when a desired product or size becomes available again on the Site, through the “Notify Me” functionality.

    Legal basis: this processing is based on the performance of a purchase contract to which you are a party; the provision of the Personal Data listed above is necessary for this purpose, since otherwise Diesel will not be able to process your request.

    b. Sales related services

    Diesel may need to process your Biographical Data, Contact Data and certain Sales Data (tax code and/or VAT number, passport number and Global Blue card number) to manage your purchase when concluded by phone or other methods provided for by Diesel, or issue an invoice, should you request it. Moreover, these data will be processed also to re-contact you for reasons connected with your purchase, for example in case of complaints, to recall a faulty and/or unsafe product or, in general, for technical reasons, e.g., related to the management of problems with refused credit card payments and similar.

    Legal basis: this processing is based on the performance of a purchase contract to which you are a party; the provision of the Personal Data listed above is necessary for this purpose, since otherwise Diesel will not be able to process your request.

    c. After-sales services

    Diesel may collect your identifiers, contact data, and biographical data to process specific requests that you may formulate in the shop, during post-sales; for example, to arrange a repair, a customization, a home delivery or to manage a return.

    Legal basis: this processing is based on the performance of a purchase contract to which you are a party; the provision of the Personal Data listed above is necessary for this purpose, since otherwise Diesel will not be able to process your request.

    d. Loyalty program Registration

    The identifiers, contact data, purchase data, loyalty data and biographical data will also be collected by Diesel to manage your request to join the loyalty program (called “House of Diesel”, whose Regulation is available at the following link). These data will be processed to complete your membership and for all purposes strictly connected to it or instrumental, including – firstly – all the activities provided for in the loyalty program. Registration could take place: i) both online through the Site; ii) offline in the participating shops, by completing the application form present in electronic (tablet or another smart tool) format or through flyers (distributed in shops) with a special QR code, through which customers can join the program themselves via the Site, iii) through further official channels of Diesel S.p.A., (for example, but not limited to social networks such as Facebook, Instagram, WeChat etc.), or iv) through the Customer Service.

    All communications relating to the loyalty program may be made by Diesel via the Site, SMS, MMS, Wallet, e-mail, newsletter, social networks and/or any other official communication channel of Diesel. All these communications relating to the program itself are sent solely for the purpose of making available the benefits related to it and do not constitute marketing communications.

    Furthermore, by creating an account on the website in the reserved area, the User will become part of the Diesel’s loyalty program. If you wish to take advantage of the services available on the Site (e.g., purchase products) without joining the program, simply choose the “Guest” option where available (e.g., during checkout for payments).

    In the event that you are registered in the loyalty program and decide to withdraw your consent or opt-out to marketing, you will continue to receive communications relating to benefits (such as the Birthday or Anniversary Gift or preview access to the new collections and promotions only reserved to members).     g. Contact management – re-contacting the customer

    Diesel may need to use your Biographical Data and Contact Data in order to re-contact you in the post-sales process if necessary (by way of example but not limited to, re-contact may be required to deal with forgotten items in the shop, to return lost items etc.).

    Legal basis: this processing is based on the legitimate interest of Diesel in the pursuit of improving its performance and its relationship with the clients.

    3.2 PURPOSES OF DIESEL S.P.A


    Diesel HQs is the company that designs, sells and promotes the brand’s products “Diesel”. It is the company maintaining the contacts with you if you decide to participate in initiatives promoted by Diesel as prize competitions or other promotional initiatives; Diesel HQs is also the company managing the loyalty program that you can sign in. Diesel HQs will process Personal Data for the following purposes.

    a. Loyalty program Registration

    The identifiers, biographical data, and contact data will also be collected by Diesel HQs to manage your request to join the loyalty program (called “House of Diesel”, whose Regulation is available at the following link). These data will be processed to complete your membership and for all purposes strictly connected to it or instrumental, including – firstly – all the activities provided for in the loyalty program. Registration could take place: i)online through the Site; ii) offline in the participating shops, by completing the application form present in electronic (tablet or another smart tool) format or through flyers (distributed in shops) with a special QR code, through which customers can join the program themselves via the Site, iii) through further official channels of Diesel S.p.A., (for example, but not limited to social networks such as Facebook, Instagram, WeChat etc.), or iv) through the Customer Service.

    All communications relating to the loyalty program may be made by Diesel via the Site, SMS, MMS, Wallet, e-mail, newsletter, social networks and/or any other official communication channel of Diesel. All these communications relating to the program itself are sent solely for the purpose of making available the benefits related to it and do not constitute marketing communications.

    Furthermore, by creating an account on the website in the reserved area, the User will become part of the Diesel’s loyalty program. If you wish to take advantage of the services available on the Site (e.g., purchase products) without joining the program, simply choose the “Guest” option where available (e.g., during checkout for payments).

    3.3 PURPOSES OF THE JOINT DATA CONTROLLERS (DIESEL HQs AND OTB)


    Diesel HQs and OTB operate as joint controllers on the basis of a specific agreement for the purpose indicated below.

    a. Customer profiling

    With your consent, the Joint Data Controllers will be entitled to process identifiers, biographical data, contact data, commercial information, purchase data, loyalty data, the data collected in the shop, navigation data, and other similar network activity for profiling purposes and for business analysis, that is for analysis on your purchase preferences consisting of automated processing of the above mentioned Personal Data. This processing is aimed at analytically knowing or predicting your purchasing preferences, and also in order to create customer profiles and customize the commercial offer so that it is more in line with your preferences.

    Legal basis: this processing is based on the consent you have given.

    You will be entitled at any time to withdraw your consent to be subject to profiling by writing to privacy@diesel.com or otherwise by contacting the Joint Controllers at the addresses indicated in paragraph 1.

    3.4 PURPOSES OF ALL DATA CONTROLLERS (DIESEL, DIESEL HQs, OTB) OR JOINT DATA CONTROLLERS (DIESEL HQs ANDOTB)


    Finally, each Data Controller or Join Controller may need to comply with a specific legal provision to which it is subject or to defend its own right in court.

    a. Purposes related to the obligations established by laws or regulations, by decisions/requests of competent authorities or by supervisory and control bodies

    Each Data Controller or Joint Data Controller may process your Personal Data to comply with a legal obligation to which it is subject.

    Legal basis: compliance with a legal obligation.

    The provision of data for this purpose is mandatory because in the absence of data the Data Controller or the Joint Data Controller will not be in a position to comply with their legal obligations.

    b. Defense of rights during judicial, administrative or extra-judicial proceedings and in disputes arising in connection with the services offered

    Your Personal Data may be processed by each Data Controller or Joint Data Controller to defend their rights or take legal action or make claims against you or third parties.

    Legal basis: this processing is based on the legitimate interest pursued by the Data Controller or Joint Controller to protect their rights.

    4. COOKIES; WHAT PROCESSING ACTIVITIES WE CARRY OUT IF YOU’RE USING OUR WEBSITE AND YOU NAVIGATE WITHOUT BEING LOGGED IN

    The Site is owned by Diesel. It is possible to browse the Site without logging in. In this case, while browsing the Site, we inform you that the computer systems and software procedures used to operate the Site acquire, during their normal operation, some data whose transmission is implicit in the use of Internet communication protocols.

    6. HOW AND HOW LONG WE WILL PROCESS PERSONAL DATA


    The Personal Data provided to and/or collected by the Data Controllers or the Joint Controllers are processed and stored with automated tools and, in some cases, may be processed and stored on a paper backing. In particular, the Personal Data processed for purposes of marketing and of customer profiling will be entered and stored in the CRM systems that allow the processing of Personal Data for these purposes.

    The Personal Data will be stored for the time necessary to achieve the purposes for which they were collected. In particular, the following rules will apply:

  • data collected to enter into and perform purchase contracts on the Site or in shops, including payments: up to the conclusion of administrative and accounting obligations. The billing data will be kept for 10 years from the billing date;
  • data of the registered user for joining the loyalty program: the data will be kept as long as the account is active. Even after the termination of the account, we will retain the data if this will be necessary to comply with legal obligations, to protect our rights or to prevent fraud;
  • data related to data subjects’ requests: the data will be stored until the request is satisfied;
  • data collected and processed for customer satisfaction will be retained for 30 days;
  • if you have provided your consent, the data processed for purposes of marketing and customer profiling will be stored for a period of 7 years. In any case, you will not be contacted again for marketing and profiling activities 7 years after your last interaction with us or even earlier if you revoke the consent previously given.     8. WHO WILL PROCESS PERSONAL DATA


    The Personal Data will be processed by:

    • employees and collaborators of the Data Controllers or of the Joint Controllers processing data under the authority of the Data Controllers or of the Joint Controllers;
    • employees and collaborators of the Data Processors designated by the Data Controllers or Joint Controllers, including (i) the companies managing the shops and the online store and who will be entitled to view, modify and update the Personal Data entered in the CRM systems through which the Data Controllers or the Joint Controllers carry out the processing activities for marketing and profiling purposes (ii) the companies managing the storage of the Personal Data of the Data Controllers or Joint Controllers based on agreements or local regulations;
    • third parties established in the European Union and also outside the European Union, Data Processors, used by the Data Controllers or Joint Controllers in particular for services of: personal data acquisition and data entry, shipping, mailing of promotional material, after sales assistance and Customer Service, market research, management and maintenance of the CRM systems through which the Data Controllers or Joint Controllers carry out processing activities for marketing and profiling purposes and of the other corporate information systems of the Data Controllers or Joint Controllers of the processing.     • Personal Data may also be disclosed to third-party service providers, independent data controllers, in particular to freelancers or companies providing legal or tax advice and assistance and to companies managing payments made by debit or credit cards or for fraud prevention and management activities.   • to receive the copy of the Personal Data you provided us (so-called “data portability”);
  • the rectification of the Personal Data in our possession;
  • the erasure of any Personal Data in relation to which we no longer have any legal basis for processing;
  • the limitation of the way in which we process your Personal Data, within the limits set by the applicable law data protection law.
  • Right to object: in addition to the rights listed above, you always have the right to object at any time to the processing of your Personal Data carried out by the Data Controller or Joint Controller for the pursuit of its legitimate interest.

    You also have the right to withdraw, in whole or in part, the consent to the processing of Personal Data concerning you for the purpose of sending advertisements or direct selling or for carrying out market research or commercial communication with automated contact methods (email, other remote communication systems via communication networks such as, for instance: SMS, MMS, messaging platforms, etc.) and traditional contact methods (mail).

    If you prefer that the processing of your Personal Data is carried out solely through traditional contact methods, you can object to the processing of your Personal Data carried out through automated contact methods.

    The exercise of these rights, which can be done through the contact details indicated in paragraph 1, is not subject to formal constraints.     If you believe that the processing of your Personal Data is carried out in breach of the provisions of the GDPR, you have the right to lodge a complaint with your local competent Data Protection Authority or to start the appropriate legal actions before the competent courts.

    11. YOUR CALIFORNIA PRIVACY RIGHTS & HOW WE RESPOND TO “DO NOT TRACK” SIGNALS

The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising under or relating to the interpretation, applicability, enforceability, or formation of this Privacy Statement, including any claim that all or any part of this Privacy Statement is void or voidable. This Privacy Statement has been made in, and shall be construed in accordance with, the laws of the State of New York, without giving effect to any conflict of law principles. The parties acknowledge that this Privacy Statement evidences a transaction involving interstate commerce. Notwithstanding the provision in the preceding paragraph with respect to applicable substantive law, any arbitration conducted pursuant to the terms of this Privacy Statement shall be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16).
